RERA Registration Mandatory Even for OC-Ready Projects, Experts Say
Mumbai: Developers of residential real estate projects in India must register their projects under the Real Estate (Regulation and Development) Act, 2016 (RERA), even if marketing or sales start only after obtaining an Occupancy Certificate (OC), legal experts and regulators have consistently emphasized.
Under Section 3 of RERA, no developer is permitted to advertise, market, book, or sell any property in a real estate project without first registering with the relevant State Real Estate Regulatory Authority (S-RERA). Compliance is triggered by the intent to sell or advertise, not by the stage of construction.
The Role of the Occupancy Certificate (OC)
An Occupancy Certificate (OC) is issued by municipal authorities to confirm that a building has been constructed according to approved plans and safety norms, and is fit for habitation. Many developers market units after obtaining an OC to assure buyers of readiness and reduce perceived risk.
