Many homebuyers and sellers often come across the term dual agency in real estate and wonder what it really means. Understanding it is important because dual agency works differently from traditional real estate representation, and in some states, it’s even illegal.

What Is Dual Agency?

Dual agency happens when one real estate agent or agency represents both the buyer and the seller in the same transaction.Instead of having two separate agents negotiating for each party, a dual agent acts as a neutral facilitator.

This setup is legal in some places, but dual agency is illegal in several states because it can lead to conflict of interest.

Benefits of Dual Agency

Even though it has some risks, dual agency still offers advantages in certain situations:

  • Faster Communication: One agent manages everything, so updates, negotiations, and paperwork move quicker.
  • Simplified Process: With only one point of contact, both parties often find the transaction smoother and less stressful.
  • Possible Cost Savings: Some dual agents reduce their commission since they earn from both sides of the deal. This can lower the seller’s overall cost.

When Should You Consider a Dual Agent?

Dual agency can be useful, but only in specific situations:

  • When both parties trust the agent: If the buyer and seller believe the agent is fair and transparent, dual agency works smoothly.
  • When the property is straightforward: Clear pricing, no complex legal issues, and standard market conditions make dual agency practical.
  • When both parties want a fast deal: Dual agents speed up negotiations since they already know the expectations of both sides.

However, dual agency might not be ideal when you need strong negotiation support because the agent cannot fight for only one side.
