When Can a Landlord Increase Rent?
A rent increase is allowed only in these situations:
- At the End of the Lease Term: Most agreements specify that rent can be increased after 11 or 12 months. At renewal typical hikes range from 5–10%, depending on the city and agreement.
- As per Rent Control Act Rules (State Laws): States have their own rules for rent revisions.
Example: Many states allow increases once a year or once every 2–3 years based on inflation, locality, or property age.
- When the Rent Agreement Mentions a Scheduled Increase: If your agreement includes a clause like “Rent will increase by 7% every year”; then the landlord can follow it, but not before.
- Improvements or Upgrades to the Property: Some states allow landlords to revise rent if they renovate the house, add new facilities, or upgrade the building. Rent can be increased based on cost recovery rules.
- For Commercial Properties (Market-Based Revisions): Commercial leases often include periodic rent escalations (e.g., 5% every year or 15% every 3 years). These must be contractually agreed upon.
When a Rent Increase Is Not Allowed?
A landlord cannot increase rent if:
